b. Employers: To use our services, you must be a legally registered company or organisation.

Registration and Account
a. Candidates: You are required to create an account to apply for jobs and access certain features on Flexystaff.com. The information you provide during registration must be accurate and complete.
b. Employers: You are required to create an account to post jobs and access certain features on Flexystaff.com. The information you provide during registration must be accurate and represent a legitimate company or organisation.

Job Postings
a. Employers are responsible for the accuracy of the information in their job postings. Flexystaff.com reserves the right to review and approve job postings before they are published.
b. Job postings must comply with all applicable laws and regulations. Discriminatory, fraudulent, or misleading job postings are strictly prohibited.

Candidate Applications
a. Candidates may apply to job postings through Flexystaff.com. The decision to contact and hire a candidate lies solely with the Employer.
b. Candidates must provide accurate and up-to-date information in their applications.

Third-Party Content
a. Flexystaff.com may contain links to third-party websites or services that are not under our control. We are not responsible for the content or policies of any linked website.
b. The inclusion of any third-party content on Flexystaff.com does not imply endorsement or affiliation.

Intellectual Property
a. All content on Flexystaff.com, including but not limited to logos, trademarks, texts, graphics, images, and software, is the property of Flexystaff.com and protected by applicable intellectual property laws.

Terms and Conditions – Flexystaff.com for Freelancers

a. Freelancers: To use our services, you must be a freelancer who provides professional services or skills on a contract basis and is at least 18 years old.

b. Registration and Account: Freelancers are required to create an account to access certain features on Flexystaff.com. The information you provide during registration must be accurate and complete.

c. Services Offered: Freelancers may create a profile on Flexystaff.com, which showcases their skills, expertise, and portfolio. They may also browse and apply for projects posted by Employers seeking freelance services.

d. Project Proposals: Freelancers must provide accurate and detailed information when submitting project proposals to Employers. They should clearly outline the scope of work, project timeline, and any relevant terms and conditions.

e. Selection and Hiring: The decision to hire a Freelancer for a project lies solely with the Employer. Flexystaff.com does not guarantee project selection or engagement.

f. Payment and Compensation: Freelancers and Employers are responsible for agreeing upon the payment terms and compensation for each project.

Flexy Staff Terms and Conditions for Gig Workers:

These terms and conditions (“Terms”) govern the relationship between Flexy Staff and individuals who choose to utilize our services (“Contractors”) for the purpose of outsourcing their information to our chosen payroll company, Clarity Contractors, for the management of PAYE (Pay As You Earn). By engaging with Flexy Staff, Contractors agree to abide by these Terms.

Contractual Relationship:
1.1. Flexy Staff acts as an intermediary between Contractors and Clarity Contractors for the purpose of managing PAYE obligations.
1.2. Contractors understand and agree that Clarity Contractors will handle their PAYE arrangements and related matters as per their internal policies and relevant legal requirements.

Outsourcing Information:
2.1. Contractors authorize Flexy Staff to share necessary personal and employment-related information with Clarity Contractors for the efficient management of PAYE.
2.2. Contractors understand that accurate and up-to-date information is crucial for the proper handling of PAYE obligations.

Payment and Deductions:
3.1. Contractors acknowledge that Clarity Contractors will deduct taxes and National Insurance contributions from their earnings in compliance with applicable laws and regulations.
3.2. Flexy Staff is not responsible for any discrepancies in payments or deductions made by Clarity Contractors. Contractors are advised to directly communicate with Clarity Contractors for any payment-related queries.

Sick Pay Concerns:
4.1. If Contractors have concerns regarding their Statutory Sick Pay (SSP) rights as a contractor or employee of Clarity Contractors, they are encouraged to contact Flexy Staff at Enquiries@ClarityContractors.co.uk.
4.2. Flexy Staff will assist Contractors in addressing their concerns regarding SSP rights by liaising with Clarity Contractors on their behalf.

Liability:
5.1. Flexy Staff shall not be liable for any errors, omissions, or discrepancies arising from the management of PAYE by Clarity Contractors.
5.2. Contractors agree to indemnify and hold Flexy Staff harmless against any claims, damages, or losses arising out of or related to the services provided by Clarity Contractors.

Changes to Terms:
6.1. Flexy Staff reserves the right to modify or update these Terms at any time without prior notice.
6.2. Contractors are responsible for regularly reviewing these Terms for any changes.

Governing Law:
7.1. These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction].
7.2. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].

By engaging with Flexy Staff, Contractors acknowledge that they have read, understood, and agree to be bound by these Terms and Conditions. If Contractors do not agree with any part of these Terms, they should refrain from using the services provided by Flexy Staff.

g. Independent Contractors: Freelancers engaging with Employers through Flexystaff.com are considered independent contractors. They are not employees of Flexystaff.com, and as such, are not entitled to benefits or protections granted to employees.

h. Responsibility for Deliverables: Freelancers are solely responsible for delivering the agreed-upon services and meeting the project requirements. Flexystaff.com is not responsible for the quality or outcomes of Freelancer services.

i. Communication and Professionalism: Freelancers are expected to maintain professional communication with Employers and conduct themselves ethically throughout the project engagement.

j. Termination of Services: Either party may terminate a project engagement in accordance with the terms agreed upon between the Freelancer and the Employer. Flexystaff.com is not responsible for project terminations.

k. Feedback and Ratings: Employers and Freelancers may provide feedback and ratings about each other after completing a project. Feedback should be honest, constructive, and based on the actual experience with the other party.

l. Disputes: In the event of a dispute between a Freelancer and an Employer, both parties are encouraged to communicate and resolve the matter amicably. Flexystaff.com may, at its discretion, offer mediation assistance but is not obliged to do so.

m. Relationship with Flexystaff.com: Freelancers’ use of Flexystaff.com does not create any employment or agency relationship between the Freelancer and Flexystaff.com.

n. Compliance with Laws: Freelancers are responsible for complying with all applicable laws and regulations related to their freelance activities, including tax obligations.

o. Indemnification: Freelancers agree to indemnify and hold Flexystaff.com, its employees, directors, and affiliates harmless from any claims, liabilities, damages, expenses, and costs arising from their use of the website and services.
